Participation for the World Cup Betting Pool

For all players and forum members of its game “Seafight“, Bigpoint Sàrl and Co, SCS (“Bigpoint“) offers a free World Cup Betting Pool (“Betting Pool“) on the website http://www.kicktipp.de/seafightwc2014/ as well as a free prize contest in the context of the betting pool. Participation in the World Cup Betting Pool and the prize contest as well as their implementation are subject to the following provisions.

1 Contest Participation

(1) The contest is organized and executed by Bigpoint. Prizes are offered exclusively by Bigpoint. Claims to prizes in court do not exist.

(2) A participant automatically partakes in the contest by registering once on the portal kicktipp GmbH at http://www.kicktipp.de/seafightwc2014/ during the period from June 6, 2014 until July 13, 2014 as well as by participating in the betting pool with the account created (“Betting game account“). Participation is free and is not subject to the purchase of one of Bigpoint's or an affiliated company's products. The game rules found at http://www.kicktipp.de/seafightwc2014/spielregeln (“Game rules“) apply. Contest participation is only possible upon accepting the Terms & Conditions of Participation as well as the Game Rules.

(3) The following contest prizes will be awarded:

Participants who finish in the following places will each be credited the following prizes in their Seafight game accounts which they used to register for the betting pool by providing their User ID (“Game account“).

1st place: Three Leo bonus maps as well as 50,000 pearls and 100,000 burning ice cannonballs

2nd place: Two Leo bonus maps as well as 25,000 pearls and 75,000 burning ice cannonballs

3rd place: One Leo bonus map as well as 10,000 pearls and 50,000 burning ice cannonballs

4th-10th place: Each player will receive a Libra bonus map and 50,000 burning ice cannoballs

11th-20th place: Each player will receive an Aquarius bonus map and 50,000 burning ice cannonballs

21st-30th place: Each player will receive a Taurus bonus map and 50,000 burning ice cannonballs

All participants who finish in the top thirty will also be given the King's Legacy buff.

In addition, from among all betting pool participants, a total of ten Taurus bonus maps will be raffled off to players who provided all the required information for the contest within the valid participation time period and who finished in 31st to 300th place.

2 Eligibility for Contest Participation

(1) The contest is open to persons who have reached the full legal age and are legally competent as well as to those who have registered for the game Seafight and the Seafight forum using a valid User ID and verified email address. Minors and individuals who have a restricted capacity or who are legally incompetent must obtain the consent of their legal representative before being able to participate. Only individuals may participate in the contest; the contest is not open to betting associations.

(2) In order to participate in the contest, the participant's User ID of the Seafight game account and the corresponding e-mail address used for verification must be provided.

(3) All personal and account information (User ID, date of birth, country) provided for participation in the prize contest must reflect the truth and all data for the distribution of prizes must be provided in full.

(4) Residents of the following states in the United States of America are not entitled to participate in the prize contest and therefore excluded from the prize contest: Arkansas, Arizona, Connecticut, Florida, Delaware, Indiana, Iowa, Illinois, Louisiana, Maryland, Montana, Nebraska, South Dakota, South Carolina, Tennessee or Vermont.

(5) A maximum of 10,000 participants are allowed to participate in the betting game and prize contest (i.e. a maximum of 10,000 betting game accounts can be registered).

3 Contest Exclusion
(1) Bigpoint employees as well as their relatives are not eligible to participate and therefore are not included in the distribution of prizes.

(2) All persons who have access to the game's game ACP or any other access or viewing rights into gameplay are strictly excluded from participating in the prize contest.

(3) Should a participant violate these rules of participation or use any illegal methods or manipulate the game in any way or form, Bigpoint reserves the right to disqualify the participant from the prize contest and to declare any prizes as invalid and recall them.

(4) Any persons who provide false information about himself/herself or his/her account shall be excluded from the prize contest.

(5) Should a person excluded from the prize contest participate in the betting pool and finish in a place relevant for the distribution of prizes, this person's placement shall be excluded from the distribution of prizes and all ranking placements following thereafter will move up one position. The next placed player will take the place of the eliminated person and so on (e.g. Should a Seafight Community Manage finish in 24th place, his/her placement will not be factored into the prize distribution and the next placed player will move up in the ranking. The 25th placed player will move up to the 24th position and the participant in 26th place will also move up to 25th place).

4 Contest Execution and Procedure

(1) Upon registering for the betting pool, a “point account“ will be set up for each participant. This account is required for the Terms & Conditions of Participation as well as the Game Rules and is used to keep track of the current score. By participating in the betting pool, players can earn points which are then credited to the participant's point account. The number of points credited to this account are determined based on the game rules. Points earned cannot be transferred to third parties and/or any other participants.

(2) After the participation period has ended, the winners of prizes for first to third place, fourth to tenth place and 21st to 30th place will be determined as based on the point accounts and, if necessary, in accordance with 3 paragraph 5. In the case of a tie in total points, the number of days on which a player won (“victories“) will determine a betting player's placement in the ranking. Should there also be a tie in the number of victories, the winner will be randomly selected by a computer. The game rules, betting rules and point rules relevant for determining how many points shall be awarded are to be taken from the game rules. Only players who have provided complete and accurate information shall be considered for the determination of winners. The prizes for betting pool participants who made all bets within the valid period of participation shall be determined randomly by a computer.

(3) Within ten days of the period of participation ending, Bigpoint shall distribute prizes to individual winners at the address provided or by crediting the winners' game accounts. Any custom duties incurred or any extra costs incurred for delivery abroad are to be borne by the winner. Should it not be possible to deliver a prize to a winner due to reasons of the winner's own making, the respective winner shall bear the costs of having to redeliver the prize. Should it not be possible to deliver the prize to the winner within four months due to reasons of the winner's own making, the prize shall expire without replacement.

(4) Only one prize can be awarded per participant and per household. Bigpoint explicitly reserves the right to disqualify any participants registered twice (double participation) or in this regard to stop any suspicious submissions or mass mails.

(5) No cash payment of prizes is possible. Should Bigpoint not be able to deliver the prize in the design offered (e.g. color), the winner shall be given a prize of the same value or a voucher which must be redeemed all at once. Claims to prizes or claims for compensation are non-negotiable.

(6) Complaints must be sent to Bigpoint in writing within 14 days of a problem's occurrence and must state the name of the relevant contest. Complaints made by telephone or those made after the deadline will not be addressed.

(7) Any operational, ancillary or supplementary costs arising from prizes are to be borne by the winner.

5 Premature Termination of the Prize Contest

Bigpoint reserves the right to interrupt or end the prize contest without any prior notice at any time. Bigpoint can make particular use of this option, for example, due to technical reasons (e.g. virus in the computer system, manipulation or errors in hardware and/or software) or due to legal reasons of having to ensure the proper operation of the game. Should Bigpoint have to terminate the prize contest due to a participant's behavior, Bigpoint can demand compensation from this person for damages incurred.

6 Data Privacy

(1) Players must be registered in order to participate in the prize contest. The ability to register is not guaranteed. Upon registration, the participant expressly gives Bigpoint his/her consent to save all necessary data for the duration and execution of the prize contest. The participant has the right to revoke the consent of data storage and thereby withdraw from the prize contest at any time.

(2) In relation to participants' registered data, Bigpoint is obliged to observe the rules of data protection. In particular, all data is to be treated as confidential.

7 Liability

(1) Bigpoint's liability ends with the delivery of the contest prize. Bigpoint is not liable for any defects and/or deficiencies.

(2) Bigpoint is not liable for any damages which could occur during participation in the contest as a result of errors, delays or interruptions in transmission, defects in technical equipment and services, incorrect data, loss or deletion of data, viruses or anything that can otherwise occur through participating in the prize contest, unless they are the result of gross negligence or deliberate action of Bigpoint (including its institutions, employees or vicarious agents). Bigpoint is however fully liable for guarantees, damages arising from breach of contractual obligations whose fulfillment facilitates the proper execution of contractual relationships and for damages caused to loss of life, physical injury and health.

(3) There is no liability to and for those persons excluded by § 3.

(4) For technical failures leading to game unavailability, delays, interruptions and/or malfunctions, Bigpoint is not liable in so far as willful conduct or gross negligence does not exist.

8 Miscellaneous

(1) No legal recourse is allowed.

(2) These Terms & Conditions of Participation, as well as the entire legal relationship between participants and Bigpoint, are subject to Luxembourg Law.

(3) In the event that one or more stipulations of these Terms & Conditions of Participation should be or become invalid, the other stipulations of the Terms & Conditions of Participation shall remain valid.

(4) Any addenda or supplementary agreements must be made in writing for validity to take effect.

(5) Bigpoint reserves the right to modify these Terms & Conditions of Participation at any time and without notice.
